Terms of Service

These terms govern your use of EmberShape's tools, including EmberBot and any other tool made available through your account's weight budget. By signing in, you agree to them. If you don't agree, don't use EmberShape.
Eligibility
You must be old enough to lawfully agree to these terms in your country, and you must meet the minimum age required by whichever platform you sign in with (for example, Discord requires users to be at least 13). If you're using EmberShape on behalf of an organization, you're confirming you have the authority to bind that organization to these terms.
The service
EmberShape gives you one account linkable to multiple platform identities, and a catalog of creator tools funded by a weight budget that scales with your subscription tier. Free tier gives you EmberBot at its free-tier caps with no subscription required. We may add, change, or retire individual tools over time; we'll aim to give you reasonable notice before retiring something you actively use.
Your account
You're responsible for the platform accounts you connect and the actions EmberShape's tools take on your behalf as a result, including anything EmberBot does in a Discord server you've authorized it for, and anything posted through a platform connection you've enabled. Only connect servers and platforms you have the authority to connect. Keep the platform accounts you sign in with secure; we can't protect your EmberShape account if the underlying platform account is compromised.
Your content
You keep full ownership of any content you create, upload, or publish through EmberShape's tools. By using a posting connection, you grant us a limited license to transmit and process that content solely to carry out the action you requested (for example, publishing it to the platform you chose). We don't use your content for any other purpose, and we don't claim any ownership over it.
Acceptable use
Don't use EmberShape to violate the terms of service of any platform it connects to (Discord, Twitch, Kick, TikTok, Instagram, YouTube), to post content you don't have the rights to, or for anything unlawful, abusive, or harassing. Connecting a platform through EmberShape doesn't change your obligations under that platform's own terms; you're still bound by them, including YouTube's Terms of Service for any connected YouTube channel. Don't attempt to disrupt, reverse-engineer, or gain unauthorized access to EmberShape's systems.
Billing
Paid tiers are billed on a recurring basis through Stripe, at the price shown at checkout. Unless stated otherwise, subscriptions renew automatically until you cancel. You can cancel at any time from your Billing page; you keep access through the end of the period you've already paid for, and we don't provide prorated refunds for the unused portion of a period. If we change pricing on your plan, we'll give you reasonable advance notice before it takes effect.
Combining accounts
If you connect a platform identity that's already linked to a different EmberShape account, we'll offer to combine the two accounts into one, after you confirm. Combining is permanent: it moves every connection and linked server onto the surviving account, and if both accounts had an active subscription, the lower one is canceled.
Intellectual property
EmberShape, its name, and its branding belong to us. These terms don't grant you any rights to them beyond what's needed to use the service as intended. Everything about the software itself, aside from your own content, is ours or our licensors'.
Termination
You can stop using EmberShape and disconnect your platforms at any time. We may suspend or terminate access for use that violates these terms, and we'll generally try to give you notice and a chance to fix the issue first unless the violation is severe or we're required by law to act immediately. On termination, your right to use EmberShape ends, but sections of these terms that are meant to survive (like intellectual property, disclaimers, and liability) continue to apply.
Disclaimer
EmberShape is provided "as is," without warranty of any kind, express or implied. We're not liable for actions taken by third-party platforms (including account suspension or content removal on their end), or for indirect or consequential damages arising from your use of the service. Where liability isn't excluded by law, our total liability to you is capped at the amount you paid us in the three months before the claim arose (or, on the free tier, $0).
Indemnification
You agree to defend and hold us harmless from any claim arising out of your use of EmberShape, your content, or your violation of these terms, to the extent that claim didn't result from our own wrongdoing.
Governing law
These terms are governed by the laws of Hungary, without regard to conflict-of-law principles. If you're a consumer resident in the EU or UK, this doesn't take away any protection you're entitled to under the mandatory consumer-protection laws of your own country of residence.
Changes to these terms
If we make a material change, we'll update the date above and, where required, notify you directly. Continued use after a change means you accept the updated terms.
